Terms of Sale

Spiritus Health Ltd. is a company incorporated in Jamaica, with its registered office at Suite 11, 13 Haining Road, Kingston 5, Jamaica. You can reach us at support@spiritusja.com or on WhatsApp at +1 (876) 443-5896.

By placing an order you confirm that:

• you are 18 years of age or older;
• you are buying for lawful personal use within Jamaica, and not for resale;
• your delivery address is in Jamaica; and
• the information you provide with your order is accurate and complete.

Our products are not for sale, possession, or consumption outside of Jamaica. We may decline or cancel any order where we reasonably believe these conditions are not met. Proof of age may be requested when you order and again on delivery, and delivery may be refused if satisfactory proof of age (18+) cannot be provided.

We take care to describe our products and their measured ingredient amounts. Product images are for illustration and packaging may vary. Batches are tested against our standards before release. Nothing on the Site is medical advice, and no statement on the Site is intended as a medical claim. You are responsible for reading the safety information on the Site and for determining your own fitness to use the products.

Your order is an offer to buy. A contract is formed when we confirm the order or dispatch the products, whichever happens first. If we cannot fulfil an order or part of it if an item is unavailable, we will notify you and refund the residual order amount that has not been processed.

• Check-out will be completed by our third-party delivery service, Island Run, who may also separately inform you of their Terms and Conditions.
• Prices are shown at checkout in the currency displayed there and, unless stated otherwise, include General Consumption Tax (GCT) where applicable.
• Delivery charges and any service fees that apply to your order are shown separately at checkout before you pay, so the total you see at checkout is the total you pay.
• We accept the payment methods displayed at checkout. Payment must be received in full before dispatch, except for any cash-on-delivery option which Spiritus or Island Run may offer, which must be paid in full on delivery.
• If the price is incorrect, we are not obliged to supply at the incorrect price and will contact you before proceeding.

Delivery is made within Jamaica only, by Spiritus or our approved delivery partner, Island Run, as set out in our Shipping & Delivery Policy. You bear the risk of loss or damage to the products from the moment they are delivered to the address you provide.

Returns and refunds are governed by our Returns & Refunds Policy. Because our products are sealed consumable products, returns are limited for health and safety reasons; damaged, defective, or incorrectly supplied items will always be replaced or refunded as set out in that policy.

Our products are intended for responsible use by adults. By purchasing and using Spiritus products, you acknowledge that you understand the nature of psychedelics, have read the safety information on the Site, and assume full responsibility for your experience and for determining your fitness to use the product. Do not supply our products to anyone under 18 or to anyone outside of Jamaica.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the laws of Jamaica. Subject to that, and to the fullest extent permitted by applicable law, Spiritus Health Ltd. shall not be liable for any harm, loss, injury, or adverse experience arising from use or misuse of the products, or from use contrary to the safety information published on the Site, and our total liability in connection with any order shall not exceed the amount paid for that order.

These Terms are governed by the laws of Jamaica and the courts of Jamaica have exclusive jurisdiction over any dispute arising from them. If any provision of these Terms is found to be invalid, the remainder continues in full force. We may update these Terms from time to time; the version published on the Site when you place your order is the version that applies to it.
